1. How long will my case take?
The only honest answer is: I don’t know yet. Two major factors are outside my control: how long you take to recover, and how reasonable (or unreasonable) the insurance company decides to be. A sprain case that resolves with a short course of PT will settle much faster than a multi-year injury with ongoing treatment. Likewise, some adjusters settle after one or two conversations. Others force us into litigation. What is in our control is you keeping your medical appointments and my team obtaining your records quickly. Once you finish treatment and we have all the records, we typically see an initial offer within about 45 days.
2. How does PIP and health insurance coordination really work?
For people with no private health insurance (MassHealth, Medicare, Tricare), PIP pays the first $8,000 of medical bills and wage loss. For people with private health insurance, PIP pays the first $2,000, then everything goes through your health insurance. Copays, deductibles, and uncovered expenses circle back to PIP. It is a complicated system, but we handle that work — not you.
3. Should I speak to the insurance adjuster?
No, other than telling them where the car is located so they can inspect it. They are not your friend. Once you hire me, you can simply tell the adjuster: “Attorney Haskell instructed me not to give a statement. Please contact him directly.” Let me be the bad guy.
4. How much is my case worth?
Again, the only honest answer is: I don’t know yet. Until we know the full extent of your injuries, you finish treatment, we review all medical records, and we get the insurance company’s first offer, any number is just a guess. Once we have that first offer, we can have a meaningful conversation.
5. Will my case go to court?
Probably not — most don’t. But if it does, the case will be trial-ready. Your treatment will be reasonable and well-documented, and the providers we work with are reputable. We prepare every file as if a jury will see it, and insurance companies know we will take a verdict if necessary.
6. Should I go to my primary care physician?
Yes. Always. Your PCP is your medical “home base.” Going only to “accident doctors” creates problems. Insurers devalue treatment not overseen by a PCP and dispute whether your bills were reasonable or necessary. Your PCP’s referrals, records, and recommendations are gold.
7. How do I make sure everything is done right after a crash?
Use a registered body shop. Don’t buy unnecessary rental car insurance if your own policy’s collision coverage already applies. Follow your PCP’s referrals. Avoid providers who create liens. And let us coordinate your insurance benefits properly. That is how we protect your net recovery.
