Special Fall Bankruptcy Payment Plan

Hello everyone! I’m Attorney Louis Haskell, and I’m coming to you today from the beautiful Kinsman Cliffs overlooking Echo Lake in Franconia State Park. The air is getting cooler, and a few leaves are starting to change, which means fall is just around the corner. And with fall comes something I look forward to every year—my Favorite Fall Bankruptcy Payment Plan.

Why Fall Is Unique for Bankruptcy Filings

Year-round, we offer flexible bankruptcy payment plans because I understand that when you’re in financial distress, money is tight. In fact, I have just two simple rules when it comes to my payment plans:

  1. The first payment should be at least $200.
  2. I won’t file your bankruptcy case until I’m paid in full.

Between these two rules, I’m very flexible. However, the fall presents some unique challenges and opportunities when it comes to filing for bankruptcy. One big factor that comes into play during this season? Tax refunds.

The Problem with Tax Refunds in Bankruptcy

You see, in my upside-down world as a bankruptcy attorney, what’s good is often bad. A big tax refund is one of those things that might seem great, but in the context of bankruptcy, it can actually cause problems. That’s why I typically recommend avoiding filing for bankruptcy in the fall, as it complicates things with potential refunds. But here’s the silver lining—a large tax refund means that you may have the funds to finally pay off your bankruptcy filing.

How the Fall Bankruptcy Payment Plan Works

Here’s my special fall payment plan for bankruptcy filings:

  • Start now with a $200 payment: Once I’ve been hired and that first payment is made, you can tell your creditors to call me. When they reach out, my office will handle them, giving you a much-needed break from their constant harassment and giving you peace of mind for several months.

  • Come see me in January or February: After you’ve received all your tax documents, schedule a meeting with me early in the new year. As part of my bankruptcy services, I’ll even include a basic tax return for free! If you have more complex taxes, like rental properties or business income, we can discuss any additional fees, but for most clients, the tax return will be included at no extra charge.

  • Use your tax refund to pay the balance: When your tax refund arrives, you can use it to pay off the rest of your bankruptcy fees. This helps resolve any financial issues while ensuring that your refund isn’t a red flag for bankruptcy trustees.

Why This Plan Works

This plan doesn’t just make it easier for you to afford filing for bankruptcy—it also helps avoid some common pitfalls. If you file in the fall, the trustee overseeing your case may ask what you’ve done with any tax refund you receive. By paying part of your bankruptcy fees with that refund, you’re using it in a way that’s allowed, which avoids major complications.

Additionally, by working with me before the tax season, we can make sure you don’t accidentally “misbehave” with your tax refund. Unfortunately, I’ve seen many clients use their refunds in ways that aren’t allowed under bankruptcy rules, which causes huge problems down the road. With this plan, we can prevent those mistakes and ensure everything goes smoothly.
