Can You File Taxes Jointly If Your Spouse Does Not Have a Social Security Number?

If you are a U.S. citizen or lawful permanent resident married to someone who does not yet have a Green Card or Social Security Number, you may assume that you cannot file a joint tax return. That is not necessarily true.

This issue often comes up in immigration cases. Your spouse may still be living abroad, or both of you may already be in the United States while an immigration case is pending. Depending on your tax situation, an ITIN may allow a spouse who is not eligible for a Social Security Number to be included on a joint tax return.

Why Filing Jointly Can Make a Difference

For 2026, the standard deduction for a married couple filing jointly is $32,200. By comparison, the standard deduction at the single rate is $16,100.

The tax brackets are also wider for married couples filing jointly.

Using a simplified example, after taking the standard deduction into account, income of approximately $66,500 reaches the beginning of the 22% bracket at the single rate. For married couples filing jointly, that figure is approximately $133,000.

Reaching the 22% bracket does not mean that all of your income is taxed at 22%. Only the portion that falls within that bracket is taxed at that rate.

This can make a significant difference when one spouse earns most of the household income and the other spouse earns little or no income.

What If Your Spouse Does Not Have a Social Security Number?

An ITIN, or Individual Taxpayer Identification Number, is issued by the IRS to certain individuals who need a U.S. taxpayer identification number but are not eligible for a Social Security Number.

An ITIN is for tax purposes. It does not provide lawful immigration status, a Green Card, or employment authorization.

Depending on the circumstances, a U.S. citizen or U.S. resident for tax purposes who is married to a nonresident spouse may be able to elect to treat that spouse as a U.S. resident for federal income tax purposes and file jointly.

There is an important consequence: when this election is made, both spouses generally must report their worldwide income.

A Real Example

Our office recently reviewed a case involving a married couple who are both living in the United States. One spouse does not yet have permanent resident status or a Social Security Number, and the couple had previously filed their taxes separately.

We are now amending their federal returns for 2021 through 2025 and applying for an ITIN for the spouse.

Based on the amended returns prepared, their expected additional federal refunds total approximately $12,696, with additional Massachusetts refunds for the applicable years.

Their situation does not mean every couple will receive a refund or should file jointly. The spouse's income, tax residency, immigration circumstances, and other tax consequences must all be considered.
