Many Nonresident Aliens are Receiving Stimulus Checks Legally

There has been a lot of concern because a number of non-citizens  who have social security numbers, but not Green Cards, have been getting stimulus checks.  IRS regulations say that “nonresident aliens” are not entitled to stimulus checks.  USCIS is severely cracking down on people who receive government benefits inappropriately.  As such, people are concerned that asylum seekers, or DACA recipients, H1 visa holders, Violence Against Women applicants and the like, who are lawfully working, but receive and keep a stimulus check might be denied benefits by USCIS and ultimately deported.  However, the IRS uses a different definition of “nonresident alien” than USCIS uses.  Most people who are here working are going to meet the IRS definition of “Resident”.  As such, most people receiving stimulus checks who are not Lawful Permanent Residents may keep the money.  I discuss these issues further in this video.
